Terms & Conditions

Please read these terms carefully before engaging our services.

Welcome to IDEAL Land & Home Contractors LLC ("Company," "we," "us," or "our"). By requesting a quote, signing a contract, or using any of our services, you agree to be bound by these Terms & Conditions. If you do not agree, please do not engage our services.

1. Services

IDEAL Land & Home Contractors LLC provides land clearing, site preparation, home construction, fencing, decking, pergolas, and related outdoor contracting services throughout Arkansas. The specific scope of work will be defined in a written project agreement or contract signed by both parties prior to the commencement of any work.

2. Estimates & Quotes

All estimates and quotes are provided based on information available at the time of assessment. Estimates are valid for 30 days from the date of issuance unless otherwise stated in writing. Final project costs may vary due to:

  • Unforeseen site conditions (buried debris, unstable soil, underground utilities, etc.)
  • Changes in material costs beyond our control
  • Customer-requested changes to the original scope of work
  • Permitting requirements identified after initial assessment

Any changes to the agreed scope of work must be documented in a written change order and signed by both parties before additional work begins.

3. Payment Terms

Payment schedules are outlined in your individual project contract. General terms include:

  • A deposit (typically 25–50% of the project total) is required before work begins.
  • Progress payments may be required at defined milestones for larger projects.
  • Final payment is due upon substantial completion of the work.
  • Invoices not paid within 30 days of the due date may be subject to a late fee of 1.5% per month.

We accept cash, check, and electronic bank transfer. Other payment methods may be accepted at our discretion.

4. Customer Responsibilities

To ensure your project proceeds safely and on schedule, you agree to:

  • Provide accurate information about the property, including boundaries and any known hazards.
  • Obtain (or authorize us to obtain) all required permits before work commences, unless otherwise agreed in writing.
  • Notify us of any underground utilities, septic systems, irrigation lines, or other buried infrastructure.
  • Ensure safe and timely site access for our crew and equipment for the duration of the project.
  • Secure any required homeowner association (HOA) approvals prior to project start.

5. Permits & Compliance

We comply with all applicable federal, state, and local regulations, including environmental and land-use laws in Arkansas. Where we are engaged to obtain permits on your behalf, permit fees will be billed to you at cost. You are responsible for ensuring that proposed work is permitted by local zoning and deed restrictions.

6. Project Timeline

Estimated timelines are provided in good faith. We are not liable for delays caused by weather, acts of God, supply chain disruptions, permitting delays, or circumstances beyond our reasonable control. We will communicate material schedule changes to you as soon as they are known.

7. Warranty

We warrant our workmanship against defects for a period of one (1) year from the date of project completion. This warranty covers defects directly attributable to our work and does not cover:

  • Damage caused by customer misuse, neglect, or unauthorized modifications
  • Normal wear and tear
  • Damage from natural events (flooding, erosion, storms, etc.)
  • Material defects covered by manufacturer warranties

Manufacturer warranties on materials and equipment are passed through to you where applicable.

8. Limitation of Liability

To the maximum extent permitted by Arkansas law, our total liability for any claim arising out of or related to our services shall not exceed the total amount paid by you for the specific project giving rise to the claim. We shall not be liable for any indirect, incidental, consequential, or punitive damages.

9. Dispute Resolution

We are committed to resolving disputes amicably. If a dispute arises, both parties agree to first attempt to resolve it through good-faith negotiation. If negotiation fails, the parties agree to pursue non-binding mediation before initiating litigation. Any legal action shall be brought exclusively in the courts of Arkansas.

10. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the State of Arkansas, without regard to its conflict-of-law provisions.

11. Changes to These Terms

We may update these Terms & Conditions from time to time. The most current version will always be posted on this page with the "Last Updated" date above. Continued use of our services after changes are posted constitutes your acceptance of the revised terms.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
